Proposed Gay Marriage Bill & Muslim Silence

Scrutinise the Gay Marriage Bill

How the West was won: An analysis of the Gay Rights Movement Part 1
How the West was won: An analysis of the Gay Rights Movement Part 2

All praises be to Allah and may peace and blessings be upon His final messenger, ameen.

The agenda to legalise gay marriage has now become a huge problem. Politicians and celebrities alike are falling over themselves to be seen supporting this abomination which is promoted as the greatest civil rights issue of our time. One would have expected such a major civil rights issue to have made it into the manifestos of the three main political parties; yet a firm commitment was conspicuous by its absence in all three parties’ manifestos.

This Same Sex Marriage Bill is not aimed at changing the legislation regarding what marriage is per se, yet it is most definitely aimed at changing a universal Divine law that has been established since the creation of mankind.

The gay lobby has invested much time, effort and money in changing the public’s perception of homosexuality and has effectively created a public fear of criticism against this unnatural act with the label of ‘homophobia’. In fact, along with the help of morally degenerate people in society they have terrorised others not to speak out or show any form of objection to their agenda. It is shocking to see a Conservative government, which on one hand is seemingly adamant to “preserve British Values” and morality, then acting cowardly and accepting this fundamental change to the oldest institution known to man: the stability of the society; a stable and natural family unit.

During the recent debate about Same Sex Marriage (SSM), there has been a clear absence of the Muslim voice; this is a reflection of the fear within the Muslim community and in particular Muslim institutions to raise their concerns.  When the Church of England and the Catholic Church do not cower from questioning the absurdity of the government in its attempt to re-define marriage and when their religious leaders openly oppose this misguided agenda, they are well within their rights to question the lack of a vocal response from the Muslim community.

Yet this is more than about how we are perceived by others. Muslims have to be undeniably clear and vocal in opposing this bill. I should make it clear that any Muslims who do not do anything to oppose this bill while he or she can do something even if it is minimal, are sinful and will be questioned about this at the Day of Judgment. The Prophet, peace be upon him, was once asked by his wife, Zaynab bint Jahsh RA:

“I said, ‘O Messenger of Allah, will we be destroyed even though there are righteous people among us?’ He said, ‘Yes, if evil becomes overwhelming.’ ”

Allah says in the Qur’an,

“And when We intend to destroy a city, We command its affluent but they defiantly disobey therein; so the word comes into effect upon it, and We destroy it with [complete] destruction”. [2]

Yet he is the one who said, “So why were there not among the generations before you those of enduring discrimination forbidding corruption on earth – except a few of those We saved from among them? But those who wronged pursued what luxury they were given therein, and they were criminals.  And your Lord would not have destroyed the cities unjustly while their people were reformers”. [3]

Although Muslims have to oppose this bill and the normalisation of homosexuality as “a radical and aggressive change of the organic Divine law” we need to be aware that this will have a detrimental effect on the lives of every single member of the whole society and more worryingly our children. As an example, let’s look very briefly at how the lives of children will be changed by the legalisation of SSM by looking at Canada.  Canada legalised SSM in July 2005.  Since then gay organisations have been free to promote homosexual practise in schools.  The Accepting Schools Act, an anti-bullying law, was passed in June 2012. This law requires all schools to run ‘gay-straight alliance’ clubs if the students request one.  This is a means by which homosexuality has become the ‘norm’.  School resources have also changed to reflect the new law, including tips for gay sexual activity.

Phil Lees of the Family Coalition Party of Ontario recounts from a mother who contacted him about a mock Grade 3 same-sex wedding ceremony in February 2012, in a school in Hamilton, Ontario:

“My son returned home from school and I asked, ‘How was school today?’
He responded, ‘Today in class I married my best friend James.’ To this, I asked, ‘How did that happen?’
My son shared, ‘Well, today we talked about love (close to Valentine’s Day) and that some boys fall in love with girls and some girls fall in love with boys, but sometimes girls fall in love with girls and boys fall in love with boys and get married.  Then she thought it would be a good idea for us to find a friend (of the same sex) in class to marry.  Then a person dressed like a minister performed a ceremony and we all got married.  Then we celebrated with cake and ice-cream.’”

We should understand undoubtedly that homosexuality and gay marriage is not about two people loving each other as it is misleadingly portrayed; it is a completely inhumane sexual activity where by one of the married males will act as a female and accept the other male to cohabit with him accordingly. A man can’t have sex with a man except when one of them is acting as a female and accepting to be penetrated by the other. A male private part cannot penetrate another male private part and the same can be said about lesbianism. It is absurd to see that the government is pursuing such an immoral agenda despite the increasing reports about the sharp decline in morality. Quoting some of these shocking reports will expand the size of this article to volumes, yet it is highly relevant to remind readers of the recent shocking news about the death of 13-year-old Chevonea Kendall-Bryan which has driven the debate on the sexualisation of young people and children to new levels. The real question is, as rightly pointed by Cole Moreton, what do we do about it? Over sexualisation is a phenomenon that needs to be tackled from various angles including countering any attempt to change the natural Divine family values known and accepted for hundreds of thousands of years.

Let us recall in the Qur’an, the story of the people of Loot:  “And (remember) Loot (Lot), when he said to his people: ‘Do you commit the worst sin such as none preceding you has committed in the ‘Aalameen (mankind and jinn)?  ‘Verily, you practise your lusts on men instead of women. Nay, but you are a people transgressing beyond bounds (by committing great sins).’  And the answer of his people was only that they said: ‘Drive them out of your town, these are indeed men who want to be pure (from sins)!’ Then We saved him and his family, except his wife; she was of those who remained behind (in the torment). And We rained down on them a rain (of stones). Then see what was the end of the Mujrimoon (criminals, polytheists and sinners)”. [4]

The prophet Loot, unlike all other prophets mentioned in the Qur’an, did not call his people to worship Allah. No definite answer can be confirmed, yet it seems and Allah knows best, that Allah wants us to focus on the gravity of the sin Loot fought against.  Again, it is needless to quote the overwhelming numerous evidences regarding the psychological, moral and health issues that result from diverting from a natural sexual life. For example, see the latest facts revealed by the Health Protection Agency (HPA) about the “Highest-ever HIV diagnoses in gay men.” [5]

Scientists have confirmed there has been a return of ‘risky’ sexual practise. Their study suggests a huge improvement in testing for and treating HIV yet they have failed to curb infections in gay and bisexual men in England and Wales.[6]

I am shocked to notice that Muslims are underestimating the danger of this law on the whole society once it is passed. It is true that the government has assured religious organisations that they will not be forced into conducting marriages against their religious beliefs, that school teachers will be able to maintain their right not to teach anything which goes against their individual beliefs but what is promised in the run up to the SSM Bill cannot be guaranteed by anyone, especially the government.

The stark reality is this law will pave the way for compulsory teaching of homosexuality in primary and secondary schools.  Some of this is already taught at present but can be rightfully challenged by parents. The SSM Act once passed will entrench aberrant behaviours as normal in the minds of our innocent children, and we as parents will have no right to remove our children from such classes. Faith schools will also not be exempt from these changes.

On Tuesday 5th February 2013, Parliament will witness a crucial point in the passage of the bill, the Second Reading. The minimum you can do is the following:
1) Contact your MP today – tell him/her how strongly you feel about the issue at a personal level, that you will follow how they vote and that you have a long memory!

2) Contact family and friends and make sure they either email or meet their MP before Tuesday 5th.
To locate the contact details of your local MP please go to the Parliament website, http://findyourmp.parliament.uk/

Muslims in the UK should attempt to participate in any capacity to show their full objection of this bill and should also be ready to take further steps in the near future.

May Allah protect us all especially our children ameen.

Shaykh Dr. Haitham al-Haddad is a jurist who seeks to contextualise classical Islamic knowledge for the modern era. He is a firm believer that Islam is uniquely qualified — more than any other system — to build a divine civilisation capable of helping humanity to enjoy a better life in all spheres by maintaining the correct balance between the rights of the Creator and the rights of the creation. He believes Islam is the only viable alternative to the failing unjust and oppressive contemporary world systems, as Allah says: "You are the best nation produced [as an example] for mankind: you enjoin what is right, forbid what is wrong, and believe in Allah." (al-Qur'ān, 3:110) According to this verse, Shaykh Haitham identifies the pillars of Islamic reform as īmān (faith), unity of the Ummah, impactful action, and knowledge. Drawing from his expertise in Islamic principles — Usūl al-Fiqh, Maqāsid al-Sharī‘ah, ‘Aqīdah, and other Islamic sciences — he promotes these foundational pillars to guide the Ummah’s revival. He is known for developing advanced theories that explore the role of Islamic jurisprudence in obtaining solutions for the contemporary challenges facing humanity, and he critically re-evaluates how Islamic legal rulings (fatāwa) can be formulated in light of modern sociopolitical realities. Shaykh Dr. Haitham al-Haddad earned his PhD from SOAS, University of London, with a doctoral thesis on Islamic jurisprudence concerning Muslim minorities. He also holds a bachelor’s degree in Sharī‘ah and Law from the University of Omdurman, Sudan, and a degree in engineering from the renowned King Fahd University of Petroleum and Minerals (KFUPM) in Saudi Arabia. He has undertaken intensive studies in management, becoming a certified ISO 9000 auditor. In addition, he has studied various Islamic sciences under leading scholars of the Muslim world, including the former Grand Mufti of Saudi Arabia, Shaykh ‘Abdul-‘Aziz ibn Baz, among many others. He has obtained many classical ijāzāt in various Islamic sciences, including Qur'ān and Hadīth. Shaykh Haitham has served as an Islamic judge for several UK-based arbitration and legal bodies for over 20 years; he is a judge at Islamic Council. He has delivered hundreds of courses on topics such as Fiqh, ‘Aqīdah, Usūl al-Fiqh, Maqāsid al-Sharī‘ah, Tafsīr, Sīrah, Islamic Thought, Islamic Leadership and Management, Da'wah, Reform, and Political Engagement. Shaykh Haitham has also submitted many academic papers in many universities around the world. He is frequently consulted by numerous Islamic organisations across Europe and beyond, and serves as a senior scholar at Islam21c. Shaykh Haitham has lectured in various universities around the Muslim world, provided counsel to Islamic institutions, authored several books and textbooks for different institutions, and travelled extensively to advocate for the reform and unity of the Ummah.

Homosexuals are indeed a vile group of individuals. I agree that the government has no place in sanctioning marriage. But where is the outrage against Muslim dominated regions when they execute these people? These people are sinners but don’t deserve to be stoned or thrown off of cliffs as practiced in Islam

    Salam Alaikum wa JazakAllahu khairan.

Indeed the truth must be spoken and this should be the position of the entire Muslim community. Would we accept Zina as acceptable ? Of course not…May Alllah give Muslims to speak the truth..

But just a remark and clarification about your point: ,”The prophet Loot, unlike all other prophets mentioned in the Qur’an, did not call his people to worship Allah. ”

    Ana Allah says: 16:36

And We certainly sent into every nation a messenger, [saying], “Worship Allah and avoid Taghut.” And among them were those whom Allah guided, and among them were those upon whom error was [deservedly] decreed. So proceed through the earth and observe how was the end of the deniers.

Every Prophet instructed their people to worship Allah in his oneness, and it is not imaginable that a Prophet would not call to his people to worship Allah. Actually, this would be slanderous to say about a Prophet.

Perhaps we may say that he is not quoted in the quran as directly saying this but it is understood from the general teachings of the Quran..

And in reference to what Loot AlaihiSalam said in 15:68-69 : [Lot] said, “Indeed, these are my guests, so do not shame me. And FEAR ALLAH and do not disgrace me.”

And all mankind are reminded to fear Allah because of his Lordship and being the Creator as in Sura Nisa verse 1: يَـٰٓأَيُّہَا ٱلنَّاسُ ٱتَّقُواْ رَبَّكُمُ ٱلَّذِى خَلَقَكُم مِّن نَّفۡسٍ۬ وَٲحِدَةٍ۬

Is it imaginable that he did not learn this most important message from his cousin Ibrahim, who was throne in the fire for calling people to Allah; and when he debated with the people about the sun moon and stars in Harran. And Allah says about Ibrahim:

    فَـَٔامَنَ لَهُ ۥ لُوطٌ۬‌ۘ وَقَالَ إِنِّى مُهَاجِرٌ إِلَىٰ رَبِّىٓ‌ۖ إِنَّهُ ۥ هُوَ ٱلۡعَزِيزُ ٱلۡحَكِيمُ

If Lut did not learn from Ibrahim the essence of calling to Allah’s worship then what did he learn, and what did he convey?

    And The people of Lot were not Muslims, so he must have called them to faith : فَأَخۡرَجۡنَا مَن كَانَ فِيہَا مِنَ ٱلۡمُؤۡمِنِينَ (٣٥) فَمَا وَجَدۡنَا فِيہَا غَيۡرَ بَيۡتٍ۬ مِّنَ ٱلۡمُسۡلِمِينَ
Then we brought forth such believers as were there. (35) But We found there but one house of those surrendered (to Allah).

And Allah says in Sura Shura, that before he warned them against homosexuality he ordered them to fear Alllah and obey him:

    (160) When their brother Lot said unto them: Will ye not ward off (evil)? (161) Lo! I am a faithful messenger unto you, (162) So keep your duty to Allah and obey me. (163) And I ask of you no wage therefor; my wage is the concern only of the Lord of the Worlds. (164) What! Of all creatures do ye come unto the males,

Would request that this point be corrected in regards a Messenger of Allah and so people don’t get the wrong idea..

    Wasalam Alaikum

Islam states homosexuality is a big sin. Full stop. If you believe in Islam you have to accept it. Islam also states adultery and extramarital sex is a big sin. Yet many Muslims still succumb to their lusts. To the current Western values both of these are the rights of the individuals. Still they have such a thing as statutory rape and in some countries only the males get punished even if it was consensual. It’s all man made laws not God’s law. Life in this world is a test for the individual and if you succumb to your lusts you failed one of the important tests as Muslim. It is not easy these days with so many temptations and the freedom that is given especially in the west to commit such sins. The end is near I guess.

Dr Al-Haddad does not merely believe “homosexuality is a big sin. Full stop.”
He believes homosexual activity should be punished by torture. He also believes that about other so-called sins.

Don’t you get tired of these bigoted myths? You don’t have to agree with the threat of capital punishment for *PUBLIC ACTS OF SODOMY*, but if you didn’t try to mischievously spin it as a ‘punishment against gays’ tabloid slogan at least you would have some respect. Here lies the difference between agreeing to disagree, and just being a bigot.

What is the threat of punishment against “*PUBLIC ACTS OF SODOMY*” – and ” *PUBLIC ACTS OF SODOMY*” only – in the Koran or Dr al-Haddad’s writings? Both are petty plain that public acknowledgement of homosexuality and detected homosexual behaviour should be punished by death.
Do you want to bring about the introduction of sharia law, with its enforcement of lethal torture against certain “crimes”? If so, then it is not merely a matter of something people can agree to disagree about, any more than favouring the re-introduction of the blasphemy law under which Thomas Aikenhead was hanged is merely a matter about which people can agree to disagree.
What is the threat of imposing the death penalty for “*PUBLIC ACTS OF SODOMY*” except a demand for ‘punishment against gays’, whether or not tabloids say it is?

Dr. Haitham, the right of the Gay people to legalize same sex marriage is the EXACT SAME right that has legalized for you the right to wear your thowb and cap, say your five times prayers, stop the British government from deporting you or put you in a concentration camp. Wisen up, Dr. Haitham, and don’t shoot youself and the British Muslims in the foot!

fruits of the lessor of the two evils
I commend the Sheikh for openly speaking against homosexuality and the same sex marriage but would like to condemn the Muslim MPs who supported this bill.

It is shocking that Muslim MPs do not speak nor promote their values. This can only be explained due to their weak mentality a mentality that believes they should do nothing that would upset their party bosses or damage their career.

Also, I believe that some of our ulema are also to be blamed for encouraging or justifying these weak people to go to parliament on the basis of lessor of the two evils. These ulema always argues that to go to parliament or join non-Islamic parties would allow the Muslims to influence the decision making process for the interests of the Muslim community. In actual fact what we are witnessing now is that rather than influencing others these MPs have become influenced.

All along, those who are against participation in this kufr system, have argued that going into parliament will entail legislating against Allah’s laws; that these MPs will have to follow party line; and that they would be inluenced has now been clearly proven.

And as a final point why do Muslims find legalising gay marriage as haraam and a problem but do not find the process by which it was legalised i.e. humans legislating not a haraam?

    Democratic sham
Subhanallah – they said yes! What is happening to this country?
I contacted my MP and got all my family to contact theirs. However, this was a vote of conscience so the MPs will vote however they like. I asked my MP (Greg Hands) how this is allowed to happen that he is a representative of the 182,445 people of Hamersmith & Fulham and that the only reason we dont all go to the Commons to vote is because we would not all fit. Therefore this Greg Hands is supposed to represent us, but actually he will be representing himself. This system is a joke.
I know of only one person amongst all the people on working on site who is in favour of this. Everyone here is either Christian, Muslim and 1 Sikh, and nobody other than the boss next door argues in favour of this.
It is a fact that if you give someone an inch they will take foot, and the queers have done exactly that. Originally they just wanted to hold hands in public, then kissing in the street (urrrgh), then adopting children (you know they are going to teach that poor little boy to be gay and may Allah protect him from them when he reaches 14-15), then pass laws against people sacking them for being generally revolting, and now they want to teach it in school.

Utter double standards. Curb your rights as a minority and it is an infringement of your freedoms. Curb the rights of other minorities and it is ok. Boys who grow up with same sex parents will not be gay ipso facto. Those boys who grow up with same sex parents are not in danger of sexual abuse ipso facto. It is views such as yours – your disgust, your abhorrence of something that has nothing to do with you – that underlies the abuse we face. All the pious words of not hating homosexuals but the act of homosexuality is rendered a sham by the vast majority of Muslim brothers and sisters. A whole group of believers driven to the brink of apostasy and despair by the likes of you who, sadly, there are many of. A Gay person kissing affects you how? They are not forcing you to kiss them! Your children grow up in this country and you teach them it is not from our religion or culture to have boyfriends or girlfriends; you teach them it is not in our religion or culture to drink alcohol; to seek high interest from banks and shares; to go clubbing; to dabble in recreational drugs etc. Your children understand and see these as separate from the tradition they are born into, so how does affording a minority a certain right to express their love (and how do you arrogate to yourself the authority to claim it is NOT love!) end up corrupting ‘our’ children irrevocably? I pray to Allah to rid us of the habit to speak with a forked tongue and replace those whose religion does not pass their throats with those whose mere demeanor has the power to turn hearts (ameen).

All humans are created with different attributes. This goes against the current mindset of trying to make everyone equal.

Human behaviour and disposition follows a Gaussian distribution. Almost all humans fit within the wide central band. This is universally considered normal behaviour. People here will be friendly, hospitable, heterosexual and so on. At the outer limits, you get people who have their wiring mixed up. Some will be merciless killers, some will be dishonest all their lives, some will want to engage in self harm, some will only desire same gender. These outer limit traits only occupy a small percentage of the population. For homosexuals, its around 1%.

The arises because these people prefer certain professions, like politics, media and law. The danger here is that they can use their position to impose their lifestyle preferences onto the majority.

Sometimes, merciless and evil people like Hitler can also influence the masses in a similar manner. He was a powerful orator and politician.
